Feasibility can be empirically demonstrated easily enough.
Which of your competitors' networks do you want me to ping probe with ToS
flags enabled?
[Although I suppose I should add the disclaimer that things have changed
for the worse in this regard since diffserv overtook the tos flags so
maybe you can win this easily now. Alas.]
